Consumer Compliance

Here's a short list of compliance laws and/or regulations that we test for you.

A financial institution with many consumer products has a high degree of consumer compliance risk by virtue of the nature of the products, the numbers of customers using the products, and the number of consumer laws and regulations that apply to these products. To be successful, financial institutions need educated staff with sophisticated knowledge of consumer protection laws and regulations commensurate with the products and services in the institution's overall business strategy.

Every employee at every financial institution around the world must follow the laws, regulations, policies and procedures that govern the industry. When institutions are found non-compliant, they may face significant penalties, including large fines and closure. When employees are found non-compliant, they may be banned from the banking industry. Ultimately, the overall responsibility for compliance remains with senior management and the board of directors.

Early detection of regulatory violations or deficiencies in policies and operating procedures is crucial to minimizing the potential risk of regulatory criticism and consumer litigation.

We can help reduce the risk to you, your customers and your institution by providing an assessment of your policies and operating procedures. Our assessments closely resemble the Examiner's Audit and will reveal whether or not your policies and procedures are adequately protecting your institution from risk. We help you identify, before the Examiner arrives, any potential violations or errors, and we work with you to implement procedural changes to ensure a successful audit.

Upon completion of the assessment(s), you'll receive a detailed and multi-faceted written Report of Findings describing the Scope of the Review, identifying specific areas of compliance and non-compliance, and providing recommendations for enhancing your compliance performance. The report can also assist in budgeting for or reallocating human resources and other financial planning items.

We provide the support you need to ensure consumer compliance, and keep you informed about the changes and developments in current banking regulations. You'll also benefit from the added expertise of a Certified Regulatory Compliance Manager (CRCM) who is made available to you for consultation on day-to-day compliance issues.

Regardless of how little or how much help you require, our consumer compliance experts will provide the support you need to ensure regulatory compliance. Don't face compliance issues alone. Contact us today.

What is
Consumer Compliance?

Consumer compliance requirements are a series of directives established by United States Federal government agencies that summarize hundreds of Federal laws and regulations applicable to financial institutions. Beginning in the 1960s, Congress began writing legislation in response to consumer complaints alleging discrimination and unfair or deceptive lending practices. This early legislation laid the foundation for more protections and subsequent enforcement actions through present day. Changes in legislation and its enforcement make it clear that consumer compliance legislation will continue to evolve and will remain a force with which to be reckoned in the years to come.
